Selling a House As Is in Texas
As is means the buyer takes the house in its current condition and you will not make repairs. It does not mean you can stay quiet about what is wrong with it, and it does not have to mean a cash buyer at a discount.
What as is does and does not do
The TREC contract has an as is provision; checking it tells the buyer not to expect repairs. Unless your sale falls under one of the statute's exemptions, such as an executor selling during probate, the Seller's Disclosure Notice under Property Code 5.008 still applies, and so does the general duty not to hide known defects. Foundation movement, a roof claim, flooding, an unpermitted addition: disclose them. If the buyer negotiates and pays for an option period in the TREC contract, they can still inspect and walk away or renegotiate during it, even on an as is sale. As is sets expectations; it is not a shield.
Who buys as is
- Cash buyer companies. Fast, certain, and priced for their margin. Expect an offer well below the listed value, because they are paying for repairs, holding, resale and profit.
- Local investors and flippers. Often better than the national companies and reachable through an open market listing.
- Owner occupants who want a project. In Lakewood, the M Streets and Oak Cliff these buyers exist in numbers and they often pay more than investors, because they are not pricing in a resale margin.
When as is on the open market wins
If the house is livable and the problems are known, an as is listing with a clean disclosure, a pre listing inspection report and honest photos usually nets more than a cash offer, because all three buyer types compete. If the house is uninhabitable, in probate with a deadline, or you need to be gone in two weeks, the cash route can be right. Get both numbers before you decide. Questions people ask
What does as is mean in Texas?
The buyer accepts the property in its current condition and the seller will not make repairs. The TREC contract has an as is box. It does not remove the duty to disclose known defects.
How much less do cash buyers pay?
Companies that buy houses typically price well below what the house would bring listed, because they are covering repairs, holding costs, resale costs and their margin. Get a listed number before you accept a cash number.
Can I sell as is and still use an agent?
Yes, and it is often the best net. An as is listing on the open market reaches cash buyers, investors and owner occupants at once and lets them compete.
